5. Content & Intellectual Property

You grant Wake and Make Media a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, create derivative works, distribute, publicly perform, publicly display, and otherwise use your User Content in connection with operating, improving, and promoting the Services. This license continues for as long as your User Content is protected by intellectual property rights.
- Representations. You represent and warrant that (a) you own or have the necessary rights to the User Content, and (b) your User Content and our use of it will not violate any law or the rights of any third party.
- Testimonials. If you submit a testimonial, you authorize us to use your name, likeness, company name, and statements for marketing, in any media, worldwide, without additional compensation, consistent with applicable law.

- Infringe or misappropriate the intellectual property, privacy, or other rights of others.
- Upload malicious code or interfere with the proper functioning or security of the Services.

- Impersonate any person or entity or misrepresent your affiliation.
- Bypass, damage, or circumvent any security or access controls.
We may, in our sole discretion, suspend or terminate access for violations of this section.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID TO US FOR THE SERVICE THAT GAVE RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (II) USD $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability shall be limited to the fullest extent permitted by law.
